What should I expect from a mediation clause in a freelance contract?

I’m finalizing a contract with a new client and they’ve included a clause about resolving disputes through mediation before any lawsuit can be filed. I’ve never actually been through that process and I’m not sure what to expect in terms of cost or how binding the outcome might be for my small freelance operation.

I signed a similar clause once. The process was run by a private mediator and we split the fee. It showed up as an hourly rate plus a small admin charge from the service. For a half-day session it was a few hundred dollars; longer ones could push toward a grand. Either way, you typically pay the mediator whether you settle or not.

From what I’ve seen, the outcome isn’t binding unless you sign a settlement. You still decide to walk away or to accept terms, and that signed agreement becomes the contract that matters.

Budget wise it’s a hurdle for a freelancer. You’ll likely need to budget for prep time, collecting docs, and maybe a quick call with the client to prep. Some folks bicker over who pays the mediator if a settlement is reached, which can muddy things.
