What are my legal options for a neighbor encroaching on my property line?
#1
My neighbor's new fence is about six inches over my property line according to my survey. I’ve brought up the issue of property line encroachment with him, but he’s refusing to move it or even acknowledge the problem. I’m not sure what my legal options are here, or if I should just let it go to avoid a bigger fight.

I had a neighbor issue like this last year, a fence drifting over the line by about six inches. I hired a surveyor to recheck, then dropped a calm note with the results. It took time, but we eventually got the fence to pull back toward the correct line.

I kept it simple and waited a bit, then suggested mediation. Having a neutral third person listen helped us set a plan and a deadline for next steps.

First move for you should be a fresh survey and a written statement from the surveyor. Then you can show that to your neighbor and ask for a path to fix it, with a clear deadline.

I tried to force a quick fix and it flared into a bigger fight. The stress was real, and the cost of legal work felt hard to justify for a few inches.

I logged photos on several dates and noted where the markers sat. That log came in handy if the dispute goes to mediation or if a professional needs to re stake.

Do you have a copy of the survey or the official property lines in writing yet?
