What rights do I have after a landlord enters without proper notice?
#1
I’m trying to figure out if I have any legal recourse after my landlord entered my apartment for a “routine inspection” without giving the required 24-hour notice. The lease agreement states they must provide advance notice except in emergencies, and this was just to check the HVAC. It left me feeling really unsettled about my privacy.

That happened to me once. I hadn’t seen any advance notice and then they were inside fixing something and left before I could say I needed a heads up. The lease says advance notice unless it’s an emergency, but I’m pretty sure HVAC checks count as maintenance not emergencies. I started keeping a tiny log: date, time, what they looked at, who was with them, and any promises about future visits. It helped me feel a little less exposed, even if it didn’t change the visit.

I wandered into a tenant rights page after the incident and learned that many places require written documentation or a heads up in advance. I’m not sure my building covered it fully. I tried to talk to the manager calmly, but it felt like I was negotiating my own privacy with a clock ticking. If you’re in a lease that hints at this, maybe your next step is to request a written policy or calendar of maintenance visits.

Do they have to give you advance warning before every routine check, or can they claim some protocol allows a quick entry?

I’m torn here. I did a quick call to a local tenants clinic and they suggested documenting what happened and following up in writing, but they warned it might not be worth pursuing unless there’s a pattern. Honestly I’m still unsettled and not sure if the problem is how they entered or if I’m just anxious about the responsibility to monitor every single day.
